Blair Avenue is a site close to the heart of Ingleby Barwick and well located so that shops and local services are just a few minutes walk from the site. The use of the site for independent elderly living seemed a concept that could be supported by the LPA but would require careful presentation of arguments on access, design and loss of open space.
The scheme was initially rejected by the LPA but allowed at appeal. The appeal gave rise to a number of legal precedents that have caused the local council to change the way in which it does business, particularly in respect of the progression of legal agreements. Prism Planning advised on structural flaws with legal thinking ahead of the appeal, points upheld by the Inspector.
