A proposal for a substantial Anaerobic Digestion facility, involving the use of farm wastes and imported food wastes to generate heat and electricity was allowed at an appeal on a site in County Durham. In addition to winning the appeal, which was dealt with by an Informal Hearing, we obtained a full award of costs against the Council for what was considered by an Inspector to be an unreasonable set of reasons for refusal.
We were able to convince the Inspector that the visual impact of the proposals was far less than feared and commissioned specialist supporting reports on noise and odour to satisfy him that the operation wouldn’t give rise to a problem on site. As far as we know, this was the first appeal of this nature in the country and set a significant precedent.
Work has now started on site to build the facility.
