Easby Cabin Development, Richmondshire – Second Appeal Win
When Prism was first formed in 2008, one of our first significant appeal wins was for a proposed log cabin development on land just outside Easby in Richmond, North Yorkshire. The client wasn’t able to proceed with the project at the time for technical and legal reasons, including the worst of the recession and Prism sought to renew the appeal as we neared its expiry date.
Despite nothing changing in terms of the appearance of the site, the Planning Authority arbitrarily sought to extend the life of the permission by just one year.
At the ensuing appeal, the planning Inspector had no hesitation recognising the lack of change in circumstances and the failure on the part of the Council to apply the government’s express view on both the renewal of permission and the proper use of planning conditions. Our client now has a full renewal of his proposals for the next three years.
